Welcome to The Spiritual Vault. These Terms of Service ("Terms") govern your access to and use of the The Spiritual Vault website, services, and applications (collectively, the "Platform"). The Platform is a marketplace that connects individuals seeking spiritual readings ("Clients") with professional psychic mediums ("Mediums").
Please read these Terms carefully. By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and The Spiritual Vault ("The Spiritual Vault," "we," "us," or "our").

1. IMPORTANT DISCLAIMER: FOR ENTERTAINMENT PURPOSES ONLY
You explicitly acknowledge, understand, and agree that:
  • 1.1. Entertainment Nature: All services, readings, advice, information, or content provided by Mediums on the Platform are for entertainment, spiritual, and educational purposes only.
  • 1.2. Not a Substitute for Professional Advice: The Platform and its services are not, and are not intended to be, a substitute for professional advice, diagnosis, or treatment in any field, including but not limited to, medical, mental health, financial, or legal fields. You should always seek the advice of a qualified and licensed professional for any questions you may have regarding a medical condition, legal issue, financial matter, or other professional concern.
  • 1.3. No Guarantees: The Spiritual Vault and its Mediums make no guarantees, representations, or warranties, express or implied, regarding the accuracy, relevance, or quality of the information and advice provided. The future is not predetermined, and any statements about future events are expressions of opinion only.
  • 1.4. Personal Responsibility: You are solely responsible for all decisions and actions you take based on your interpretation of a reading or any interaction on the Platform. The Spiritual Vault and its Mediums shall not be liable for any loss or damage resulting from your reliance on any information or content obtained through the Platform.

2. User Accounts
  • 2.1. Eligibility: You must be at least eighteen (18) years of age and have the legal capacity to enter into a binding contract to use the Platform.
  • 2.2. Account Registration: To access most features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • 2.3. Account Types:
    • Client Account: For users seeking to download readings.
    • Medium Account: For professional mediums providing services. Mediums may be subject to a separate application, vetting, or approval process at the sole discretion of The Spiritual Vault.
  • 2.4. Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Services, Payments, and Refunds
  • 3.1. Digital Readings: Mediums provide digital readings to Clients through the Platform's messaging or delivery system. The format and timeline for delivery will be specified in the reading description.
  • 3.2. Fees: The Spiritual Vault acts as a payment collection agent for its Mediums. When a Client purchases a reading, they agree to pay the fees specified. We may charge a service fee or commission on transactions, which will be disclosed to Mediums.
  • 3.3. Payment: All payments are processed through a third-party payment processor (e.g., Stripe, PayPal). By making a purchase, you agree to be bound by the third-party processor's terms of service.
  • 3.4. Refund Policy: Due to the personal, digital, and entertainment-based nature of the services, all sales are final, and payments are non-refundable except in the following circumstances, at our sole discretion:
  • There is evidence of technical failure on the Platform preventing delivery.

4. Content Ownership and Licenses
  • 4.1. User Content: All information, text, and materials you post or otherwise make available on the Platform, including Reviews and the content of Readings, is "User Content."
  • 4.2. License to The Spiritual Vault: By creating User Content, you grant The Spiritual Vault a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the User Content in connection with operating and providing the Platform. This license is necessary for us to display reviews, deliver readings, and manage content.
  • 4.3. Ownership of Readings: The Medium who creates and delivers a reading retains the intellectual property rights (copyright) to that specific reading content. However, by delivering the reading, the Medium grants the purchasing Client a limited, worldwide, non-exclusive, non-transferable license to use the reading for their own personal, non-commercial use. The Client may not publicly display, sell, or redistribute the reading without the Medium's explicit written permission.
  • 4.4. Reviews: Clients may leave public reviews for Mediums. By submitting a review, you grant The Spiritual Vault an unrestricted right to display this review on the Platform. Reviews must be truthful, based on your own experience, and must not violate our Code of Conduct. We reserve the right to remove any review that violates these Terms.

5. Code of Conduct
All Users agree not to:
  • Violate any applicable law or regulation.
  • Harass, threaten, stalk, defame, or otherwise infringe on the rights of others.
  • Use the Platform for any purpose other than its intended use, including attempting to solicit users for off-platform transactions to circumvent fees.
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity.
  • Post or transmit any content that is fraudulent, obscene, pornographic, vulgar, or offensive.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Upload any software, viruses, or malicious code.
  • Attempt to gain unauthorized access to the Platform or its related systems or networks.

6. Role of the Super Admin
You acknowledge that The Spiritual Vault employs administrators ("Super Admins") who have the authority to:
  • Access and manage all user accounts (Medium and Client).
  • View, moderate, and remove any User Content (including readings and reviews) that violates these Terms or is deemed inappropriate at our sole discretion.
  • Manage disputes between users, although we are not obligated to do so.
  • Suspend or terminate user accounts for violations of these Terms.
  • Create and manage the public-facing content and pages of the Platform.

7. Termination
  • 7.1. Termination by You: You may terminate your account at any time by contacting us or through the contact form or via email (hello@thespiritualvault.com).
  • 7.2. Termination by Us: We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.
  • 7.3. Effect of Termination: Upon termination, your right to use the Platform will immediately cease. Sections 1, 4, 8, 9, 10, and 11 of these Terms will survive termination.

8. Disclaimers of Warranties
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE PLATFORM, ITS CONTENT, OR THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SPIRITUAL VAULT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS PLATFORM OR SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT OF FEES YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED BRITISH POUNDS (£100).

10. Indemnification
You agree to defend, indemnify, and hold harmless The Spiritual Vault and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.
11. Governing Law and Dispute Resolution
  • 11.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
  • 11.2. Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any legal matter arising from these Terms.
  • 11.3. Disputes Between Users: The Spiritual Vault is not a party to any agreement or dispute between Clients and Mediums. While we may, in our discretion, provide a dispute resolution mechanism, we have no obligation to mediate or adjudicate disputes between users.

12. General Provisions
  • 12.1. Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Platform or by other means of communication. Your continued use of the Platform after any such change constitutes your acceptance of the new Terms.
  • 12.2. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Spiritual Vault regarding your use of the Platform.
  • 12.3. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.
